Public Comment: Flood Resiliency Education for Local Governments and Community Leaders in West Virginia

PUBLIC NOTICE: The Land Use Law Clinic at the West Virginia University College of Law (Land Use Clinic) is submitting an application under the West Virginia University CDBG-MIT Regional and Local Planning Grant Program administered by the West Virginia Development Office (WVDO). The Program is funded by the U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant - Mitigation (CDBG-MIT) allocation as described in Public Law 115-123. The Land Use Clinic is requesting up to $250,000 to achieve project goals. The project will provide training and education to local governments regarding flood mitigation. The Land Use Clinic will develop a flood resilience toolkit for local governments in West Virginia and provide several regional workshops to train leaders on specific legal, planning, and regulatory tools to improve flood resilience. Educational activities will take place in flood-impacted areas of West Virginia, including Clay, Greenbrier, Kanawha, and Nicholas counties and target local decision-makers and other MIT stakeholders from those counties, as well as Summers, Monroe, Fayette, Pocahontas, Webster, Jackson, Roane, and Lincoln counties. Specific locations of regional training sessions will be identified during the planning phase of the project but will generally occur near flood-impacted communities. The impacted population will include residents and property owners of incorporated and unincorporated areas within the counties listed above. The toolkit will follow West Virginia state law and be available to all local governments in West Virginia. One training session will be held via Zoom, recorded, and archived for flexible access.

Public Comment: Community Rating System Training for Local Governments in West Virginia

PUBLIC NOTICE: The Land Use Law Clinic at the West Virginia University College of Law (Land Use Clinic) is submitting an application under the West Virginia University CDBG-MIT Regional and Local Planning Grant Program administered by the West Virginia Development Office (WVDO). The Program is funded by the U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant - Mitigation (CDBG-MIT) allocation as described in Public Law 115-123. The Land Use Clinic is requesting up to $250,000 to achieve project goals. The project will provide training and education to local government officials regarding the Community Rating System. The purpose of this project is to improve flood resilience by increasing participation of local governments in West Virginia in the Community Rating System (CRS). As of 2018, only five municipalities and eight counties (out of 232 municipalities and 55 counties in West Virginia) participated in the CRS program. The Community Rating System provides incentives for local governments to implement regulations and activities that go beyond the minimum requirements of the National Flood Insurance Program (NFIP). 42 U.S.C. § 4022(b)(1). The primary incentive for CRS participation comes in the form of discounted flood insurance premiums for residents. 42 U.S.C. § 4022(b)(2). Nineteen activities that merit points are divided into four categories: public information, mapping and regulations, flood damage reduction, and warning and response. Educational activities will take place in flood-impacted areas of West Virginia, including Clay, Greenbrier, Kanawha, and Nicholas counties. Attendees from surrounding counties will also be invited. Surrounding counties include Summers, Monroe, Fayette, Lincoln, Logan, and Pocahontas. Public Comment: Legal and Planning Services for Clay County, Greenbrier County, Richwood, Rainelle, and South Charleston

PUBLIC NOTICE: The Land Use Law Clinic at the West Virginia University College of Law (Land Use Clinic) is submitting an application under the West Virginia University CDBG-MIT Regional and Local Planning Grant Program administered by the West Virginia Development Office (WVDO). The Program is funded by the U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant - Mitigation (CDBG-MIT) allocation as described in Public Law 115-123. The Land Use Clinic is requesting up to $250,000 to achieve project goals. The project will provide planning assistance to local governments, prioritizing communities with Clay, Greenbrier, Kanawha, and Nicholas Counties. The purpose of this project is to improve long-term flood resilience through land use planning that incorporates resiliency. Although the West Virginia Code requires that plans be updated at least every ten years, the best practice is to update plans whenever significant events (such as an extreme flooding event) have occurred that change the community outlook. The project provides planning services to the following flood-impacted communities:

  • Clay County does not currently have a comprehensive plan and needs a plan to better delineate and achieve community goals.
  • Greenbrier County needs a comprehensive plan update. The county’s plan must be updated no later than 2024. However, during updates to the county’s zoning ordinance, the planning commission recognized that an update is immediately necessary to be consistent with new zoning goals. In addition, the plan has not been updated since the 2016 flood.
  • Greenbrier County needs a SALDO update. During the process of updating the zoning ordinance, the planning commission realized that some of the updates desired for the zoning ordinance are more properly part of the SALDO. The SALDO has not been updated since 2012, and a number of provisions need to be addressed.
  • The City of South Charleston does not currently have a comprehensive plan and needs a plan to better delineate and achieve community goals.
  • The Town of Rainelle needs a comprehensive plan update. The town’s plan must be updated no later than 2023 and should be updated to reflect changes since the 2016 flood.
  • The City of Richwood needs a comprehensive plan update. The city’s plan must be updated no later than 2026 and should be updated to reflect changes since the 2016 flood.

All planning efforts will go beyond minimum compliance of the West Virginia Code to incorporate flood resilience throughout the planning process. The impacted population will include residents and property owners of jurisdictions listed above.
